You already know your builder is late. What you need is the exact sequence of steps — from checking registration to getting an enforceable order — that works when you are twelve time zones away. This guide walks through the RERA process for an NRI filing from America, one step at a time.
What RERA Is, in Two Sentences
The Real Estate (Regulation and Development) Act, 2016 set up a dedicated state-level regulator that any registered residential or commercial project must answer to, giving buyers a faster, purpose-built forum than a civil court for possession delay, plan deviation, and refund disputes. For an NRI who booked a flat years ago and is still waiting, RERA matters mainly because of what it does not require: you do not need to be physically present in India to file, argue, or collect on a complaint.

Step 1 — Confirm the Project Is Actually RERA-Registered
Before drafting anything, verify the project's registration on the relevant state RERA authority's public website — this single check tells you which authority has jurisdiction and what the builder promised on record. Every state that has notified RERA rules (Maharashtra, Karnataka, Haryana, Punjab, Uttar Pradesh, and others) runs its own searchable portal.
How to Search
- Open the state's official RERA website and use the "search project" or "registered projects" tool
- Search by project name, promoter/builder name, or the RERA registration number on your booking agreement, allotment letter, or brochure
- Cross-check the registered completion date against what your agreement actually promised — builders sometimes apply for an extension, and that extension is itself a matter of record worth reading
- Note whether other complaints are already listed against the same project or promoter
If the search turns up no registration at all for a project sold as ready or under-construction inventory above the size threshold, that fact changes your strategy toward civil remedies rather than a straight RERA complaint, since RERA's complaint machinery presumes a registered project.
Step 2 — Build Your Document File Before You Draft Anything
RERA proceedings are decided mostly on paper, so a complete, organized document file is more valuable to your case than any argument. Gather these before contacting anyone about filing:
The Core Filing Checklist
- Booking agreement or allotment letter — the contract that sets out the price, unit, and the committed possession date
- Every payment receipt and bank/wire transfer record, including remittances sent from your US bank account, showing the exact amount and date of each installment
- Builder correspondence — emails, demand letters, WhatsApp threads, and any written response (or lack of one) to your inquiries about the delay
- Proof of possession delay — the promised date from the agreement set against the current status, site photos or updates from relatives if you have them, and the registered completion date pulled from the RERA project page in Step 1
- The project's RERA registration number and a copy of the sanctioned layout plan, where available, if your complaint involves a plan or specification deviation
- A Power of Attorney naming your advocate, if you intend to have someone file and appear on your behalf rather than doing so yourself
Step 3 — Choose How You Will File: Yourself Online, or Through an Advocate Under POA
You have two practical routes to actually submit the complaint, and most NRIs use the second one.
Option A: E-Filing the Complaint Yourself
Where the state RERA authority offers an online portal, you can, in principle, create an account, fill the prescribed complaint form, upload the documents from Step 2, and pay the filing fee by card — all from a laptop in the USA. In practice, few NRIs choose this route because the forms reference procedural details (respondent naming, prayer/relief drafting, jurisdiction selection) that are easy to get wrong, and an error at filing can cost weeks in refiling.
Option B: Filing Through an Advocate Under Power of Attorney (the route most NRIs use)
You authorize an advocate in India to file and represent you by executing a Power of Attorney — signed in the USA, notarized before a notary public or two witnesses, apostilled by your state's Secretary of State where your consulate jurisdiction requires it, and attested by your local Indian Consulate (OCI and PIO cardholders generally skip the apostille step). Once complete, your advocate can register on the portal or file physically at the authority's office, draft the complaint correctly the first time, and become the point of contact for every notice the authority issues. Step 4 — What Happens After Filing: Notice, Reply, and Hearings

Is Personal Appearance Required?
No. If your advocate holds a valid Power of Attorney, they can appear at every hearing without you being present at all. Many state RERA authorities have also continued offering video-conferencing links for hearings since the pandemic, so on the occasions your input is genuinely useful you can often join by video from home rather than flying to India. Evidence in RERA matters is overwhelmingly documentary rather than oral, which is exactly why the Step 2 document file matters more than physical presence.
How Many Hearings Should You Expect?
Simple possession-delay or refund complaints with an undisputed paper trail sometimes resolve in one or two hearings. Matters where the builder disputes the facts or several buyers are joined together can run to several hearings over a few months. Your advocate should send a short update after each one so you are never left guessing where the case stands.
Step 5 — The Order: What Relief RERA Can Actually Grant
A RERA authority's order is binding and enforceable, not advisory, and typically takes one of a few forms depending on what you asked for and what the evidence supports.
- Refund with interest — the full amount you paid, returned with interest calculated from each payment date to the date of actual refund, at the rate prescribed under the state's RERA rules, where you choose to exit the project
- Possession with a delay penalty — if you prefer to stay in the project, an order directing the builder to hand over possession along with a per-month penalty covering the delay period
- Compensation — a separate award for financial loss or hardship caused by the delay or misrepresentation, distinct from the interest component of a refund
- Rectification or price adjustment — where the complaint involves a reduced carpet area, missing amenity, or plan deviation, an order to fix the defect or adjust the price accordingly
On timeline: state RERA rules generally direct authorities to dispose of a complaint within roughly 60 days of filing. Clean, well-documented delay or refund matters often move close to that target; contested cases with disputed facts or several respondents can extend well beyond it, sometimes running several months.
Step 6 — Enforcement, or What to Do if RERA Alone Doesn't Resolve It
An order is only useful if the builder complies, and RERA gives you real teeth here: an order is executable like a civil court decree, so if the builder ignores it, your advocate can apply for execution proceedings, which can extend to attaching the builder's bank accounts or property.
If the Builder Appeals
Either side can appeal a RERA order to the state's Real Estate Appellate Tribunal, and further to the High Court on questions of law. This is normal for larger or contested cases — your advocate simply argues to uphold the original order.
If RERA Isn't the Right Forum, or Relief Falls Short
Projects that were never registered fall outside RERA's complaint machinery and point you toward a civil suit for specific performance, injunction, or damages under the Specific Relief Act, 1963.
